Welcome To The Canadian Human Rights Commission's Complaint Assessment Tool

The Complaint Form itself can be found at the end of the following information screens. You will be asked to provide three (3) kinds of information before you can access the Complaint Form:

  • You will have to choose the organization you want to complain about from a list of known federal respondents. (If you wish to file a complaint against more than one organization, you will have to file separate complaints against each one.)
  • You will have to choose the ground(s) of discrimination related to your complaint.
  • You will have to choose the discriminatory practice(s) related to your complaint.

Please note that these selections will not be transferred to the complaint form itself and will not be made available to the Commission. You will have to re-enter this information on the complaint form. You must file a complaint within 12 MONTHS of the event or situation that you are complaining about.

You WILL NOT be able to use the Complaint Form in the following situations. Call the Commission to talk to an officer in these situations:

  • If you want to file a complaint in your name if the complaint is on behalf of someone else.
  • If you want to file a complaint against an individual.
  • If you are not a Canadian citizen, permanent resident, or in Canada lawfully as a visitor, student or temporary foreign worker.

You CANNOT send your complaint form to the Commission electronically.
You will not be able to save the form electronically. If you exit the form, you will lose your data. You may wish to use a word processor to type out your allegations, and then copy and paste them into the Complaint Form. You can fill out the form by hand. After you have filled out the form, you must print it, sign it and send it to the Commission by regular mail or by fax. If you require the Complaint Form in an alternate format, contact the Commission at 1-888-214-1090 or by TTY at 1-888-643-3304.

Commission letters and documents are available in alternative formats upon request. Please advise the Commission if you wish to be reached through other formats. Always remember to keep the Commission informed of any changes to your requirements.

Below you will find information on discrimination, what kinds of things are covered by the Canadian Human Rights Act, and the Commission’s complaint process. If you have never filed a human rights complaint before, please read the information carefully. The information below deals with the federal Canadian Human Rights Act (the Act) - not with provincial or territorial laws.

WHAT IS DISCRIMINATION?

Discrimination is an action or decision that results in the unfair or negative treatment of a person or group because of their race, age, religion, sex, etc. Some types of discrimination are illegal under federal and provincial human rights laws. If you are a victim of discrimination under the Act, you can file a complaint with the Canadian Human Rights Commission (the Commission).

According to the Act, for the Commission to be able to deal with your complaint, you need the following 3 things:

WHO

1. Your complaint must be about an employer or service provider that the Commission has authority over.

WHAT

2. Your complaint must be about conduct or behaviour that is a discriminatory practice, and

WHY

3. The behaviour you are complaining about must be related to one of the grounds of discrimination.
